1. Acceptance of Terms

By accessing and using this website, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use this website or purchase any products from us.

We reserve the right to modify these Terms at any time. Changes take effect immediately upon posting on the website. Your continued use of the website after any changes constitutes acceptance of the updated Terms.

2. Products & Pricing

• Product Descriptions: We strive to ensure all product descriptions, images, and specifications are accurate. However, minor variations in color, dimensions, or features may occur due to manufacturer updates.
• Pricing: All prices are listed in Kenya Shillings (KSh) and include applicable taxes unless otherwise stated. We reserve the right to change prices at any time without prior notice.
• Pricing Errors: In the event of a pricing error, we reserve the right to cancel the order and issue a full refund. We will notify you promptly if such an error occurs.
• Availability: All products are subject to availability. We reserve the right to discontinue any product at any time.

3. Orders & Payment

• Order Placement: Placing an order constitutes an offer to purchase. We reserve the right to accept or decline any order. An order confirmation email indicates acceptance.
• Payment Methods: We accept M-Pesa (Lipa na M-Pesa Online), bank transfers, and cash on delivery (Nairobi only). Payment must be received in full before dispatch unless otherwise agreed.
• Order Modifications: Orders may be modified or cancelled within 2 hours of placement, provided they have not been dispatched.
• Fraud Prevention: We reserve the right to cancel orders suspected of fraudulent activity and report such incidents to the relevant authorities.

4. Shipping & Delivery

• Delivery Areas: We deliver across all 47 counties in Kenya. Delivery times vary by location (same-day/next-day for Nairobi, 2-7 business days for upcountry).
• Shipping Fees: Shipping fees are calculated at checkout based on location and product size. Free delivery applies to orders above KSh 5,000 within Nairobi.
• Delivery Risk: Risk of loss or damage transfers to you upon delivery. Please inspect your order at the time of delivery and report any damage immediately.
• Failed Deliveries: If delivery fails due to incorrect address or unavailability, re-delivery fees may apply.
• Commercial Orders: For bulk or commercial deliveries, special arrangements and pricing apply. Contact us for a custom quote.

5. Returns & Refunds

• Return Window: Items may be returned within 14 days of delivery for a refund or exchange, provided they are unused, undamaged, and in original packaging.
• Non-Returnable Items: Custom-ordered products, assembled equipment, and clearance/sale items are non-returnable unless defective.
• Damaged Items: Report damaged or defective items within 48 hours with photographic evidence for a free replacement or full refund.
• Refund Process: Refunds are processed within 5-7 business days of receiving the returned item. M-Pesa refunds are processed within 48 hours.
• Return Shipping: Return shipping costs are borne by the customer unless the return is due to a defective or incorrectly shipped item.

6. Warranty

• Manufacturer Warranty: All products come with the original manufacturer's warranty. Warranty periods vary by product (typically 1-2 years for equipment, 6-12 months for accessories).
• Warranty Coverage: Warranty covers manufacturing defects in materials and workmanship under normal use. It does not cover damage from misuse, neglect, unauthorized modifications, or normal wear and tear.
• Warranty Claims: To make a warranty claim, contact us with your order number, proof of purchase, and a description of the issue. We will coordinate with the manufacturer for resolution.
• Remedies: Warranty remedies are limited to repair or replacement of the defective product at the manufacturer's discretion.

7. Limitation of Liability

To the maximum extent permitted by applicable law:

• Mackfast Fitness Solution shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our products or website.
• Our total liability for any claim arising from a product purchase shall not exceed the purchase price of that product.
• We are not responsible for injuries resulting from improper use or assembly of fitness equipment. Users should follow all safety instructions and consult a physician before beginning any exercise program.
• We are not liable for delays or failures caused by circumstances beyond our reasonable control, including natural disasters, strikes, or government actions.

8. Intellectual Property

All content on this website, including text, images, logos, graphics, and software, is the property of Mackfast Fitness Solution or its content suppliers and is protected by Kenyan and international intellectual property laws. You may not reproduce, distribute, or create derivative works from any content without our express written permission.

9. Governing Law & Disputes

These Terms are governed by and construed in accordance with the laws of the Republic of Kenya. Any disputes arising from these Terms or your use of our services shall be subject to the exclusive jurisdiction of the courts of Kenya.
